Is Online Gambling Legal?

Although online gambling is generally legal in many countries, there are a few countries where online gambling is illegal.
In the United States, illegal online gambling is regulated by the Wire Act and the Illegal Gambling Business Act. It is also illegal under the Racketeer Influenced and Corrupt Organizations Act (RICO), which prohibits illegal gambling business activities.
In addition to federal laws, some state officials have expressed concerns about the Internet being used to bring illegal gambling into their jurisdictions. However, state enforcement policies have been challenged on constitutional grounds. The Commercial Activity Clause, the Due Process Clause, and the Commerce Clause all are implicated in the enforcement of federal gambling laws. These attacks have not achieved much success.
In December 2002, the General Accounting Office (GAO) published Internet Gambling: An Overview of Issues. It addressed several issues relating to online gambling and provided an assessment of the potential impact of illegal gambling on interstate commerce. However, the Report does not mention Rewis, who has been involved in cases that address gambling in general. The report does however include the text of several statutes that are cited in the CRS Report.
In addition to the Wire Act, the Lopez Amendment also regulates commercial activity. The Amendment contains elements designed to weed out low-level gambling cases. In addition to a prohibition against accepting financial instruments from illegal Internet bets, the Amendment prohibits gambling on contests. It also outlines several distinct crimes under Section 1956. These crimes include laundering, concealing, and promoting illicit activity.
The Lopez Amendment is also important because it contains Congressional findings about the impact of illegal gambling on interstate commerce. It has raised constitutional questions about the legislative power of the Commerce Clause. However, the commercial nature of the gambling business seems to satisfy these concerns. In addition to preventing illegal gambling, the state run operations are able to raise funds for government programs, relieve the taxpayer burden, and ensure that casinos comply with standards.
The Federal Communications Commission also has jurisdiction over common carriers. The Commission may eventually discontinue the furnishing and maintenance of facilities. It may also discontinue leasing of facilities. However, the commission may not be able to stop casinos from using the Internet. Some casinos enhance the lives of Native American tribes and raise funds for government programs.
There are also issues involving the Constitution’s First Amendment. Although the limited First Amendment protection provided for crime facilitating speech encumbers free speech objections, attacks based on the First Amendment guarantee of free speech have not gained much traction.
However, the Commercial Activity Clause seems to satisfy the Constitution’s Commerce Clause. It has also raised questions about the legislative power of the Due Process Clause. Although attacks based on the Commerce Clause have not proved effective, the Commercial Activity Clause seems to be a good way to limit the federal government’s ability to regulate gambling.
