The UIGEA was a major focus of litigation, and the United States v. K23 Group Financial Services case is one such instance. This case alleged that internet poker operators violated the 18 U.S.C. by providing financial instruments to persons in violation of the federal UIGEA.
While the federal government has not yet made any decisions regarding whether the Commerce Clause is applicable, its assertions have been based on First Amendment free speech arguments. This approach has largely been unsuccessful.
Other attacks have relied on the Due Process Clause, which prohibits the government from restricting free speech. However, these arguments have been weakened in the face of financial transactions that occur within the United States. Also, the question of whether legislative power is limited by the Commerce Clause has risen.
Section 1956 of the Unlawful Internet Gambling Enforcement Act creates several distinct crimes. These include laundering to conceal an illegal activity, laundering with the intent to promote an illicit activity, and laundering to evade taxes.
